Welcome to Maxed. By accessing or using the Maxed application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Maxed. By creating an account, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as needed. You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the Service or its infrastructure.
• Upload malicious code or content.
• Misrepresent your identity or impersonate another person.

4. Fitness & Health Disclaimer

Maxed provides AI-generated workout suggestions, readiness scores, and coaching insights for informational purposes only. This is not medical advice. Always consult a qualified healthcare professional before starting or modifying any exercise program. You exercise at your own risk, and Maxed is not liable for any injuries or health issues that may result from following suggestions provided by the Service.

5. Third-Party Integrations

Maxed integrates with third-party services such as WHOOP, Garmin, and Oura. Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or functionality of third-party services.

6. Intellectual Property

All content, features, and functionality of Maxed (including but not limited to text, graphics, logos, and software) are owned by Maxed and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. User Content

You retain ownership of data you submit (workout logs, profile information, etc.). By using the Service, you grant Maxed a limited license to store, process, and display your data as necessary to provide the Service. We may use anonymized, aggregated data to improve the Service.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Maxed and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the app or via email.
