Welcome to Maxed. These Terms of Use constitute an End User License Agreement ("EULA") between you and MAXED INC ("Maxed," "we," "us," or "our"). By accessing or using the Maxed application or the getmaxed.co website ("App" or "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
PLEASE NOTE: SECTION 16 CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.
Subject to your compliance with these Terms, Maxed grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.
Maxed offers the following auto-renewable subscription plans:
Maxed also offers one-time in-app purchases (such as extra body scans and AI physique generations) and creator subscriptions and content purchases through the marketplace (see Section 8). Prices are shown before purchase and may change over time; changes do not affect purchases already made.
Payment: Payment will be charged to your Apple ID account (or Google Play account on Android, or via Stripe for web purchases) at confirmation of purchase, or at the end of the free trial period if applicable.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
Managing & Canceling Subscriptions: You can manage or cancel App Store/Play Store subscriptions through your device's subscription settings. Web (Stripe) subscriptions can be managed through the billing portal in the app. Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and no refunds are provided for partial periods or unused content. Purchases made through Apple or Google are additionally subject to their refund policies.
Refund Requests: If you request a refund for an App Store purchase, you consent to Maxed sharing your in-app usage and consumption data (such as how much of the purchased content or features you have used) with Apple to help Apple evaluate and decide on the refund request. This information is shared only to process refund requests in accordance with Apple's policies.
Free Trials: If a free trial is offered, the unused portion of a free trial period will be forfeited when you purchase a subscription.
A subscription is required to access Maxed Pro features including AI-powered workout logging, personalized AI coaching, Crews & team training, the creator marketplace, body scan & physique analysis, and advanced progress analytics.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Maxed. By creating an account, you represent that you meet this requirement.
You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to update it as needed. You are responsible for all activity that occurs under your account.
You agree not to:
The Service includes social features where users can post workouts, photos, videos, reels, comments, and messages ("User Content"). You retain ownership of your User Content. By posting, you grant Maxed a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content as necessary to operate and promote the Service. You represent that you have all rights needed to post your content and that it does not violate any law or third-party right.
Moderation: We have zero tolerance for objectionable content and abusive behavior. We may remove any content and suspend or terminate any account at our discretion. The app provides tools to report content, block users, and flag abuse; we review reports and act on objectionable content promptly. We do not pre-screen content and are not responsible for User Content posted by others.
Features such as AI Body Scan, Future Physique, AI coaching, and AI plan generation use artificial intelligence (including OpenAI's API) to process data you provide, as described in our Privacy Policy. AI-generated outputs (scores, estimates, projections, plans, and images) are estimates for informational and entertainment purposes only, may be inaccurate, and are not medical, nutritional, or professional advice. You are responsible for the photos you submit and must only submit photos of yourself (or with the subject's consent). Maxed does not use your photos to identify you and does not collect biometric identifiers.
The marketplace lets creators sell workout templates, programs, classes, and subscriptions, and lets users purchase them.
Maxed provides AI-generated workout suggestions, readiness scores, body composition estimates, and coaching insights for informational purposes only. This is not medical advice. Always consult a qualified healthcare professional before starting or modifying any exercise, nutrition, or supplement program — including any protocols you choose to track in the app. Physical exercise carries inherent risk of injury. You assume all risk associated with your training, and to the maximum extent permitted by law Maxed is not liable for any injuries, health issues, or damages that may result from your use of the Service or from following suggestions provided by it.
The Service integrates with third-party services including WHOOP, Garmin, Oura, Apple Health, Apple App Store, Google Play, Stripe, RevenueCat, OpenAI, Meta (Facebook), TikTok, PostHog, Sentry, GIPHY, Google Places, Mux, and others described in our Privacy Policy. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or functionality of third-party services.
All content, features, and functionality of Maxed (excluding User Content and creator content) are owned by Maxed and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
If you believe content on the Service infringes your copyright, send a notice to support@getmaxed.co including: (a) identification of the work, (b) the location of the infringing material, (c) your contact information, (d) a good-faith statement that the use is unauthorized, (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act, and (f) your physical or electronic signature. We will respond to valid notices, including removing infringing material and terminating repeat infringers.
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app. Upon termination, your data will be deleted in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Sections 9, 11, 13, 14, 15, and 16) survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY DOLLARS ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Maxed and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your creator content, your violation of these Terms, or your violation of any law or third-party right.
Please read this section carefully — it affects your rights.
Informal resolution first: Before filing a claim, you agree to contact us at support@getmaxed.co and attempt in good faith to resolve the dispute informally for at least 30 days.
Binding arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and may be conducted remotely (by video or written submission) where the rules allow. Judgment on the award may be entered in any court of competent jurisdiction. This agreement is governed by the Federal Arbitration Act.
Class action waiver: YOU AND MAXED EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Disputes may only be brought in an individual capacity.
Exceptions: Either party may bring an individual claim in small claims court, or seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
30-day opt-out: You may opt out of this arbitration agreement by emailing support@getmaxed.co with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms, stating your name and account email. Opting out of arbitration does not affect any other provision of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles, except that the arbitration agreement in Section 16 is governed by the Federal Arbitration Act. For any matter not subject to arbitration, you and Maxed consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
If you downloaded the App from the Apple App Store: these Terms are between you and Maxed only, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for any product warranty, product claims, or third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the app or via email.
